Dish Designer Terms of Service

Welcome to DishDesigner! These Terms of Service (“Terms”) govern your use of our web application (“Service”). By accessing or using DishDesigner, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms By using DishDesigner, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to bind the organization to these Terms.

2. Account Registration To access certain features of the Service, you may need to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary.

3. Account Security You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree not to share your account information with others. You must immediately notify us of any unauthorized use of your account. DishDesigner is not responsible for any losses arising from the unauthorized use of your account.

4. Use of the Service You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation.
  • Exploit any part of the Service for commercial purposes without our express consent.
  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

5. User Content You may submit content, including recipes and meal plans, to the Service (“User Content”). By submitting User Content, you grant DishDesigner a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.

6. Intellectual Property All intellectual property rights in the Service, including all software, content, and materials, are owned by DishDesigner or its licensors. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written consent.

7. Auto-Renewing Services Certain features of the Service may be available on a subscription basis with auto-renewing payments. By subscribing to these services, you agree that your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date. You authorize DishDesigner to charge the applicable subscription fees to your payment method on file. If you do not wish for your subscription to renew automatically, you must cancel it before the renewal date. You can cancel your account at any time by visiting Membership Cancel.

8. Account Maintenance You are responsible for maintaining the status of your account and keeping your account information up-to-date. Failure to keep your account information current may result in the suspension or termination of your account. DishDesigner is not responsible for any issues arising from outdated or incorrect account information.

9. Termination We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Refunds and Cancellations For information on refunds, please visit our Refund and Returns Policy. You can cancel your membership at any time by visiting Membership Cancel.

11. Limitation of Liability To the maximum extent permitted by law, DishDesigner and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service.

12. Governing Law These Terms shall be governed and construed in accordance with the laws of Utah, United States, without regard to its conflict of law provisions.

13. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
